We may process your personal data without your knowledge or consent where this is required or permitted by law.
5. Disclosures of your personal data
We may share your personal data with the parties set out above for the purposes set out in this policy.
External Third Parties: third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.
Our partners and service providers.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
6. International transfers
Some of our external third parties may be based outside the European Economic Area (EEA) and/or the UK, so their processing of your personal data may involve a transfer of data internationally.
Whenever we transfer your personal data outside the EEA or the UK, we ensure a similar degree of protection is afforded to it by implementing one of the following safeguards:
- We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission and/or the UK Government; or
- We use certain service providers, we put in place Standard Contractual Clauses (EU SCCs) and/or the UK International Data Transfer Agreement/Addendum, together with supplementary measures where appropriate; or
- Other lawful safeguards permitted under applicable data protection law.
Please contact us if you want further information on the specific mechanism used by us when transferring your personal data internationally.
7. Data security
The security of your personal information is important to us. Although no method of transmission over the Internet or method of electronic storage is 100% secure, we have put in place appropriate security measures to reduce the risk of your personal data being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
8. Data retention
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including to satisfy any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect of our relationship with you.
To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure, the purposes for which we process it and whether we can achieve those purposes through other means, and applicable legal requirements.
By law we must keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.
In some circumstances you can ask us to delete your data. In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
9. Your legal rights
Under certain circumstances, you have rights under data protection laws (EU/UK GDPR) in relation to your personal data:
- Request access to and/or correction of your personal data.
- Request erasure of your personal data (subject to legal/contractual exceptions).
- Object to processing of your personal data based on our legitimate interests, including for direct marketing.
- Request restriction of processing your personal data in certain scenarios (accuracy, unlawful use, legal claims, or pending verification of overriding legitimate grounds).
If you wish to exercise any of the rights set out above, please contact us.
No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive, or refuse to comply in these circumstances.
What we may need from you
We may need to request specific information to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it could take longer if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.
